SIRI has updated practice note on the rule of presumption
SIRI has on 5 October updated its practice note on how we use the rule of presumption in our case processing. The new practice note replaces the old version from 2021.
Today, SIRI has published an updated practice note. It describes SIRI’s current practice and contains a general and extended review on the elements of presumption. They can be a part of our assessment when we process applications for a residence and work permit under SIRI’s work schemes that are covered by the rule of presumption.
The newer practice is based on decisions by SIRI and the Immigration Appeals Board.

Historical background
On 8 October 2021, SIRI published a practice note on how we use the regulation in the Danish Aliens Act, section 9 (26) (rejection due to presumption in work cases under the Pay Limit Scheme and the Fast Track Scheme’s pay limit track). The practice note was adjusted on 16 November 2021.
On 29 December 2020, the rule of presumption was included in the Danish Aliens Act, section 9 (26) by Act No. 2195.
