The Immigration Service reopens certain cases concerning alien’s passports for Belarusian citizens

If you are a foreign national in Denmark and you are not a refugee, it is generally a requirement for obtaining an alien’s passport that you can document that it is not possible for you to obtain a national passport or other travel document from your home country.

However, it is also possible to obtain an alien’s passport even if you cannot document this, when special reasons apply. The provision regulating this is found in section 7(5) of the Executive Order on Aliens’ Access to Denmark, which was adjusted with effect from 8 November 2024. The adjustment makes it clear directly in the provision that such a special reason may exist if it is particularly difficult for you to obtain a passport or other travel document. As a result, the general requirement that you must normally document that it is not possible to obtain a national passport does not apply in cases covered by section 7(5) of the Aliens Order, where it precisely is particularly difficult for you to obtain a passport. The Immigration Service has not provided correct guidance on this distinction in our decisions and notices of consultation regarding alien’s passports after the Executive Order was adjusted.

We have therefore reviewed applications for alien’s passports submitted by persons who could be covered by section 7(5), in cases where decisions were made after 8 November 2024. There are only a few cases, all concerning Belarusian citizens.

As a result of the review, the Danish Immigration Service is reopening the processing of three cases. In the new processing, the Immigration Service will assess whether the applicant is covered by section 7(5) of the Executive Order and thus meets the conditions for the issuance of an alien’s passport.

If you are one of the persons whose case is being reopened, we will contact you directly. You do not need to take any action yourself to have your case reopened.
