Important information for Afghanis regarding marriages performed in Pakistan

New information received by the immigration authorities from the Foreign Ministry shows that there are two different ways Afghanis can marry in Pakistan, namely that marriage may be legalised according to Afghan law or Pakistani law.

Marriages legalised by an Afghan court (Afghan Marriage Law)

In order for a marriage conducted in Pakistan to be valid under Afghan law, the couple must contact an Afghan diplomatic mission that can carry out the ceremony. To be valid the marriage must then be registered by the Afghan Supreme Court or any of its subsidiaries.

When two Afghanis married in Pakistan under Afghan law apply for family reunification of spouses in Denmark, proof of registration with the Afghan Supreme Court must be attached.

Marriages legalised by a Pakistani court (Special Marriage Laws for Foreigners in Pakistan)

Afghanis can marry in Pakistan under Pakistani marriage legislation. To be valid the marriage must be registered by the local District Co-ordination Officer.

When two Afghanis married in Pakistan under Pakistani law apply for family reunification of spouses in Denmark, proof of registration with the designated district registrar, or the registrar designated upon application to the District Co-ordination Officer, must be attached.

Processing by the Danish Immigration Service

The Danish Immigration Service is now taking this new information into account when processing applications. Following these revelations the Immigration Service has been able to grant residence permits in a number of applications that have been pending for an extended period of time.

Marriages entered into in Iran

The Danish Immigration Service is currently in the process of gathering information regarding Afghan nationals' opportunity to marry in Iran.
